GENERAL PRIVACY POLICY

BlackFin LLC (“BF”) respects your privacy, and we are committed to protecting your privacy.  Please read this privacy policy (“Privacy Policy”) to learn more about the manner in which we collect and use information that is generated when you visit the “Site”.

When you visit the Site and/or access the services offered by us, we have designed our system to protect your privacy.  Our system will be able to ascertain your geographic location from your IP address, but we do not collect e-mail addresses or track the sites that you access while you use our services unless (i) we are required to do so by law; (ii) we have reason to believe that you have violated our Terms of Use; (iii) you have caused or attempted to cause harm to us or the other users of our Site; and/or (iv) you voluntarily provide us with personal information (as described below).

Two types of information may be collected when you visit our Site: Personal and Company Information (such as name, address, telephone number, e‑mail address, credit card numbers, or credit information), which is only collected by us if you voluntarily submit it to us.  For example, if you voluntarily create an account with us through the use of BF services, we will receive the account information that you submit so that we can process your purchase order(s) and better ensure that you are receiving the products, information and/or services that you requested.  If required by law, we also share this information with certain regulators strictly to provide the services; and Aggregate Non-Identifying Information (such as information about how many visitors log on to the Site), which is automatically collected from your use of the Site.  Our servers will log IP addresses and collect third‑party sites (and information from these sites) from your use of the Site.  BF uses this information to measure the use of our Site, to improve the content of our Site, and to provide our users with the best possible services.

In sum, you can visit our Site without telling us who you are or revealing personal information about yourself.  However, you can, if you choose, participate in additional secured applications.  If you choose not to provide us with this information, you may not be able to make use of our services.  We may also, from time to time, send information to registered users about promotions, specials, system changes, or new products that we think may be of interest.  You may unsubscribe from these notifications by following instructions you receive from us, which you may access by clicking on the link labelled “unsubscribe” on any e-mails you receive or by visiting your account preferences at the Site to opt out.

BF does not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide services that you have requested, when we have your permission, or under the following circumstances:

We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.

We may transfer information about you if BF is acquired by or merged with another company. In this event, BF will notify you before what information about you is transferred and becomes subject to a different privacy policy.

We may share information gleaned from your use of the Site or the services you select with companies with whom we have marketing or other business relationships.

Cookies: We may also collect cookies.  Cookies are small files of information that are stored on your computer's hard drive by your Web browser.  We use cookies to personalize your experience with us and to keep track of your session(s).  The cookies we use do not contain any personally identifiable information.  Most Web browsers automatically accept cookies, but you can change the preferences of your browser so that it does not accept them.  In order to use all the features of the Site and/or access all of the services, we recommend that you accept cookies.

Links to Other Sites: We may provide links to third-party external sites.  The inclusion of any link does not imply our endorsement of the external site company, its website or websites, or the products and services it promotes or sells.  When you leave our Site to visit one of these linked sites, the only information transferred to the third party is the fact that you came from our Site. BF is not responsible or liable for the independent privacy policies of these third-party websites.  You should consult the privacy policies at these websites to determine how your information may be used.

Our Security Policy: We have built our website and products using industry-standard security measures and authentication tools to protect the security of your Personal Data.  We and the third parties who provide services for us, also maintain technical and physical safeguards to protect your Personal Data. We also periodically monitor our system for possible vulnerabilities and attacks, consistent with industry standards.  When we collect your credit card information through our website, we will encrypt it before it travels over the Internet using industry-standard technology for conducting secure online transactions. Unfortunately, we cannot guarantee against the loss or misuse of your Personal Data or secure data transmission over the Internet because of its nature. We strongly urge you to protect any password you may have for our website and to not share it with anyone. You should always log out of our website when you finish using it, especially if you are sharing or using a computer in a public place.  Please note that emails, instant messaging, and similar means of communication with other BlackFin website users, if any, are not encrypted, so you should not communicate any confidential information through these means.

Use of Your Credit Card : You may have to provide a credit card to buy products and services from our website. We use third-party billing services. We use our commercially reasonable efforts to make sure your credit card number is kept strictly confidential by using only third-party billing services that use industry-standard encryption technology to protect your credit card number from unauthorized use. However, you understand and agree that we are in no way responsible for any misuse of your credit card number.

Children’s Privacy: We believe that protecting the privacy of children is especially important, and for that reason it is our intention to never collect or maintain information from children at our Site.

Changes To Our Privacy Policy: We reserve the right to change this privacy policy at any time. If our company decides to change this privacy policy, we will post those changes on our website so that our visitors, users and customers are always aware of what information we collect, use, and disclose. If at any time we decide to disclose or use your Personal Data in a method different from that specified at the time it was collected, we will provide advance notice by email (sent to the email address on file in your account). Otherwise we will use and disclose our users’ and customers’ Personal Data in agreement with the privacy policy in effect when the information was collected. In all cases, your continued use of our website, services, and products after any change to this privacy policy will constitute your acceptance of such change.
